A US brand owner whose trademark registered on 2020-11-17 and who files the Section 8 declaration on 2026-12-01 pays the USPTO $1,275 on a three-class registration. Exactly $300 of that is grace fee - money that buys nothing - and the registration is cancelled after 2027-05-17. Filing the same declaration on 2026-10-01 costs $975.
The maintenance calendar for a US trademark is counted from the registration date on the certificate. The first Section 8 declaration of use is due between the fifth and the sixth anniversary of registration. After that, a combined Section 8 declaration and Section 9 renewal is due between the ninth and tenth anniversary, and then every ten years. Each of those deadlines has a six-month grace period behind it. When the grace period closes, the USPTO cancels the registration and the only way back is a new application with a new priority date.
On 2025-01-18 the USPTO restructured its trademark fees. The Section 8 declaration went from $225 to $325 per class. The Section 9 renewal is $325 per class. The grace fee is $100 per class for each statutory component, so a combined Section 8 and Section 9 filed inside the grace period is $850 per class against $650 on time. A Section 15 incontestability declaration is $250 per class and carries no grace fee. Paper filing costs more: $425 for Section 8, $525 for Section 9, $350 for Section 15, and $200 per class of grace fee. All of it from the USPTO fee schedule revised 2026-08-14.
Ask a language model what a Section 8 declaration costs and many still say $225, because that was true for the decade their training data covers. The USPTO's own page gives the fee table with no date arithmetic attached to your registration. Neither tells you the thing you need: on the day you intend to file, are you early, on time, or paying the grace fee - and when does the mark die.
A registration that entered the US through the Madrid Protocol under Section 66(a) is not maintained with a Section 8 declaration. It takes a Section 71 declaration of use, on the same 5-to-6-year and ten-year schedule, at $325 per class with the same $100 grace fee. There is no US Section 9 renewal for it - the international registration is renewed at WIPO. On the ten-year window that is real money: three classes filed late come to $2,550 for a US registration and $1,275 for a Madrid one.
US Trademark Renewal Clock 2026 is a browser extension and a free web page that share one calculation. You type the registration date, the date you plan to file, the number of classes, and whether the registration is a US or a Madrid one. Two checkboxes cover the Section 15 declaration and paper filing, and one field takes your quote per class.
It returns nine values: which filing is due, the day the window opens, the statutory deadline, the day the registration is cancelled, your status on that date, the days of margin left, the USPTO fee for all classes, the grace fee inside it, and the total with your professional fee. All nine are free, with no key and no limit, in the popup and on the web page.
An IP attorney charges $300-$500 per class for a maintenance filing. The paid tier does not gate the answer - it moves to a different axis. For $60 once you can download the worked result as a .csv row for your renewal docket, and set browser reminders that fire 30 days, 14 days and 1 day before the date you entered. One licence key per person or team seat.
You type seven things: the registration date from the certificate, the date you plan to file, the number of classes, whether the basis is US or Madrid, Section 15 on or off, paper or electronic, and your professional quote per class. It returns nine values, including the statutory deadline, the day the USPTO cancels the registration, and the exact fee.
US small-business and brand owners who filed their own trademark and now hold the registration, and IP paralegals who keep a renewal docket. Anyone who has to answer the question "is this mark still alive and what does it cost to keep it" without opening a billing file.
The fees changed on 2025-01-18: Section 8 went from $225 to $325 per class. Language models trained before that still quote $225, and the USPTO page gives the fee table but does no date arithmetic. This counts the anniversaries from your registration date and applies the grace fee.
Every calculation is free with no key and no limit: all nine outputs from all seven inputs, any number of classes, any number of registrations, in the extension popup and on the web page. The $60 licence adds two things on a different axis: a .csv export of the worked result, and browser reminders 30, 14 and 1 day before your date.
An IP attorney charges $300-$500 per class for a maintenance filing on top of the USPTO fee. Missing the statutory deadline adds the USPTO grace fee of $100 per class per component, and missing the grace date cancels the registration, which means refiling from scratch.
